Release of Liability, Waiver of Claims, and Indemnity Agreement For Participation at The Den / She Devil Jiu Jitsu

By participating in any activity at The Den, you agree to these terms in full. Full By using the facilities, services, or participating in activities at The Den / She Devil Jiu Jitsu Club (hereafter referred to as “The Den”), you acknowledge and accept that there are inherent risks involved. These risks include, but are not limited to, minor injuries (such as bruises or sprains), major injuries (such as joint or back injuries), and catastrophic injuries (including paralysis or death), whether caused by you, someone else, or The Den. In consideration of the benefits provided by The Den, you voluntarily accept all such risks for yourself and any guests, minors, or dependents you bring. You agree that The Den, its owners, officers, directors, employees, volunteers, agents, and independent contractors shall not be held liable for any injury, including physical, mental, or emotional injury, economic loss, or damage to you, your spouse, guests, unborn child, or relatives, even if caused by the negligence of The Den or anyone acting on its behalf. You further agree to indemnify, defend, and hold harmless The Den from any and all claims, demands, causes of action, damages, costs, or expenses (including attorneys’ fees), arising out of or related to any injury, wrongful death, or property damage resulting from your own negligence, actions, or omissions. Additionally, you agree to hold harmless, defend, and indemnify The Den from any claims brought by your guests, family members, or minors under your supervision—even if such claims allege negligence on the part of The Den or its affiliates. You understand and acknowledge that The Den does not manufacture fitness or training equipment, but instead purchases or leases such equipment from third parties. As such, The Den is not liable for any injury or damages arising from the use or malfunction of such equipment.
